1. Acceptance of Terms
By creating an account or using the Brandosel platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, you must not use the Service.
2. Description of Service
Brandosel provides a custom-domain professional email forwarding and alias-management platform. The Service includes:
- Custom domain email setup and DNS configuration
- Email alias creation, forwarding, and routing management
- Inbound and outbound email processing and storage
- AI-powered email features including triage, classification, and draft composition (optional)
- Team and organization management with role-based access
- Push notifications and daily digest summaries
- File storage for email attachments and brand assets
- Custom brand email signatures and logo attachments
3. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring that your account information remains current and accurate
You must be at least 16 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or are created with false information.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You must not:
- Send unsolicited bulk email (spam), phishing messages, or malware through the Service
- Use the Service to harass, threaten, defame, or impersonate others
- Transmit content that is illegal, obscene, or infringes on third-party intellectual property rights
- Attempt to gain unauthorized access to the Service, other accounts, or connected systems
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Use the Service in any manner that could damage, disable, or impair our servers or networks
- Register domains you do not own or have authorization to use
- Resell, lease, or redistribute the Service to unauthorized third parties without our written consent
- Use automated means (bots, scrapers) to access the Service without our express written permission
Violation of these acceptable use policies may result in immediate suspension or termination of your account without prior notice.
5. Email Sending Policies
Brandosel is designed for professional transactional and interpersonal email communication. You acknowledge and agree that:
- The Service is not intended for mass marketing, newsletter distribution, or cold outreach campaigns
- You must verify ownership of all destination email addresses before forwarding is activated
- Email bounces and spam complaints are monitored and managed automatically to maintain deliverability
- Excessive bounce rates or spam complaints may result in throttling or suspension of your sending privileges
- You are solely responsible for the content of emails you send through the Service
6. Domain Ownership
By connecting a domain to the Service, you represent and warrant that you are the lawful owner of that domain or have explicit authorization from the owner to configure its email routing. We verify domain ownership through DNS record validation. We reserve the right to disable any domain connection if we reasonably believe the domain is being used without proper authorization.
7. AI Features
The Service offers optional AI-powered features for email classification, summarization, and draft composition. By enabling AI features, you acknowledge that:
- Email content will be processed by third-party AI models to generate analyses and responses
- AI-generated outputs are provided as suggestions and may not always be accurate or appropriate — you are responsible for reviewing all content before sending
- Your email data is never used to train AI models
- AI features can be fully disabled at any time from your account settings without affecting other functionality
- We are not liable for any consequences arising from reliance on AI-generated content that you choose to send
8. Subscriptions and Billing
Access to the Service requires a paid subscription. By subscribing, you agree to the following:
- Subscriptions are billed on a recurring basis (monthly or annually) according to your chosen plan
- Payments are processed by our third-party payment provider (Polar) and are subject to their terms of service
- You authorize us to charge your payment method on each renewal date until you cancel
- Plan upgrades take effect immediately; downgrades take effect at the end of the current billing period
- We reserve the right to modify pricing with at least 30 days advance notice before your next billing cycle
9. Cancellation and Refunds
You may cancel your subscription at any time. Upon cancellation:
- Your subscription remains active until the end of the current paid billing period
- No partial refunds are issued for unused time within a billing period
- You may export your data before your access expires
- After the billing period ends, email forwarding and inbox access will be deactivated
- Account data is retained for 30 days after expiration to allow for reactivation, after which it is permanently deleted
Refund requests for exceptional circumstances may be submitted to billing@brandosel.com and will be evaluated on a case-by-case basis.
10. Intellectual Property
The Service, including its design, code, features, documentation, and branding, is owned by Brandosel and protected by applicable intellectual property laws. You retain ownership of all content you create, upload, or transmit through the Service (your "Content"). By using the Service, you grant us a limited, non-exclusive license to process, store, and display your Content solely as necessary to provide and improve the Service.
11. Email Customization and Brand Signature Terms
Users can customize their email signatures and configure brand colors/fonts for signature footers, subject to the following terms:
- Customized signature footers must comply with all email deliverability and anti-spam standards.
- You may upload your own brand logos and images to append to outbound messages, provided you own the intellectual property rights to those assets.
- You are responsible for ensuring that your custom HTML signatures do not contain malicious code, scripts, or links to malicious websites.
- We reserve the right to disable custom signatures or logo rendering if they violate our spam/abuse policies or trigger recipient mail provider warnings.
12. Service Availability
We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (with advance notice when possible)
- Emergency security patches or infrastructure updates
- Events beyond our reasonable control (force majeure), including natural disasters, network outages, or third-party service failures
We will make reasonable efforts to notify you of planned downtime and restore service as quickly as possible during unplanned outages.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement
- Brandosel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim
- We are not liable for the actions, content, or policies of third-party services integrated with the platform
- We are not responsible for email delivery failures caused by recipient mail server configurations, DNS propagation delays, or third-party filtering systems
14. Indemnification
You agree to indemnify, defend, and hold harmless Brandosel, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) the content of emails you send through the Service; or (e) your end-users' activities if you are an agency partner.
15. Termination
We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:
- You breach any provision of these Terms
- Your use of the Service poses a security risk to the platform or other users
- We are required to do so by law or a valid legal order
- Your account has been inactive for more than 12 months
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.
16. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Brandosel operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the competent courts of the governing jurisdiction.
17. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or an in-app notification at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you must discontinue use and cancel your subscription before the effective date.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Brandosel regarding your use of the Service. These Terms supersede any prior agreements or communications regarding the subject matter herein.
